However, by using the Service immediately after purchase, you expressly acknowledge and agree that you waive the right to withdraw for the current billing period, as the digital service has been fully provided.
7. Service Availability & SLA
We target 99.9% monthly availability, inheriting Cloudflare's infrastructure SLA. Scheduled maintenance will be communicated with reasonable notice.
We are not liable for downtime caused by: Cloudflare outages, force majeure events, your internet connection, or third-party service failures. Service status is available via Cloudflare's status page.
8. Limitation of Liability
Free tier: The Service is provided "as is" without warranty of any kind. Our liability is limited to direct damages only.
Pro tier: Our total liability is capped at the greater of: (a) 200% of the fees paid in the 12 months preceding the event giving rise to the claim, or (b) EUR 100.
We are not liable for indirect damages, including loss of profit, loss of data (beyond what is within our control), or third-party service failures.
Mandatory French law carve-outs: In accordance with Article 1231-3 of the French Code civil, the liability limitations above do not apply to damages caused by faute lourde (gross negligence) or dol (willful misconduct). These carve-outs are mandatory and cannot be excluded by contract.
9. Termination & Suspension
By you: You may terminate your account at any time by deleting it from the dashboard. You will have a 30-day window to export your data after termination.
By us: We may suspend or terminate your account for:
- Violation of these Terms
- Non-payment (Pro tier)
- Suspected fraud or security threats
- Legal or regulatory requirements
For serious violations (illegal use, security threats), termination may be immediate. Otherwise, we will provide reasonable notice and an opportunity to remedy the issue.
10. Fair Use Policy
- One free organization per user. Additional organizations require a Pro tier subscription.
- 7-day cooldown after deleting an organization before creating a new one, to prevent free-tier cycling.
- Each AuthProxy site must protect a single application. Using a proxy server to consolidate multiple backends behind one site is prohibited.
- We reserve the right to suspend accounts that abuse free-tier limits.
11. Consumer Mediation
In accordance with Articles L612-1 et seq. of the French Code de la consommation, if you are a consumer and have a dispute with us that cannot be resolved directly, you have the right to refer the matter free of charge to a consumer mediator.
You may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/ .
Additionally, you may contact the DGCCRF (Direction Générale de la Concurrence, de la Consommation et de la Répression des Fraudes) for any consumer protection inquiry.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of France. Any dispute arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of Paris, France.
